We’ve all heard of the now famous meme, “Rise and shine,” which Kylie Jenner spoke in her “Official Kylie Jenner Office Tour” on youtube about a month ago. If you haven’t… where have you been for the last month? Since then, it has become a very, very highly used and reposted meme. Naturally, Kylie went right ahead and launched Rise and Shine merch, and now there are reports that she’s sending cease and desist letters to companies that were using the iconic phrase before she even said it. Which is arguably not true. Kylie hit Twitter to clear things up, confirming that nope… she’s not suing anyone. “Guys, please don’t believe everything you read,” she tweeted. “I have not sent any Rise and Shine cease and desist letters. Rise and Shine was an unexpected moment. I had a lot of fun with it, and I have laughed so hard seeing everyone’s memes since the video came out a few weeks ago.”
After Kylie Jenner filed for the "Rise and Shine" trademark, a woman came forward to say she already owns the rights to the phrase. The Blast reports that a New Jersey businesswoman and single mother named Cathy Beggan is the rightful owner of the trademark. Now Ms. Beggan has taken issue with the fact that Kylie Jenner has already used the phrase "without the legal license or permission to do so and without any offer of compensation." This has turned into a full-on war for the rights of the famous trademark. Some fans are upset about her trademarking the phrase, though. “You cannot trademark a phrase that has been used since before you were born,” one user said. Another argued it would be the same as someone attempting to trademark “Happy Birthday.”
